ACDP against proposed release of 19 000 inmates*
ACDP Whip and spokesperson on justice and correctional services, Steve Swart, has stated that the party does not support the proposed early release of 19 000 inmates, as announced yesterday by Minister of Justice and Correctional Services, Ronald Lamola.
While we appreciate that the decision was taken to reduce overcrowding at correctional facilities in an attempt to curb the spread of the coronavirus, the focus should rather be on reducing the number of remand detainees.
As many as 5000 such inmates cannot afford to pay bail, resulting in them remaining in custody. If this is addressed, it can significantly reduce overcrowding at these facilities.
In addition, all criminal trials have been postponed due to the lockdown, adding to the overcrowded conditions. These trials should recommence as soon as possible, with adequate hygiene protocols in place.
The question also arises whether the social environment to which these parolees will be returning to will be adequately considered. Will their release not contribute to the number of people who are already struggling to access food and result in increased tension in families and communities?
Additionally, will the limited number of parole officers be able to monitor the additional 19 000 parolees, given the pressure already on the parole system?
Lastly, thousands of normally law-abiding citizens are being arrested and charged with what we believe are trivial offences relating to the lockdown provisions. This places additional pressure on an already over-burdened criminal justice system.
While the proposed early release may be well-intentioned, the unintended consequences may be more severe. We urge the parole boards considering these cases to take these factors into consideration.”
